Terms and Conditions

1. Agreement to Terms

By accessing or using the services provided by TOWNCALL LLC ("TownCall," "we," "us," or "our"), including the FirstBack missed call recovery platform, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use our services.

2. Service Description

TownCall provides an AI-powered missed call recovery service ("FirstBack") designed for home service businesses. The service includes:

  • Automated SMS response to unanswered calls within seconds.
  • AI-driven text conversations for lead qualification and appointment scheduling.
  • Appointment booking and calendar integration.
  • Contractor notifications for new bookings and leads.
  • A dedicated business phone number.
  • Monthly performance reporting.

TownCall does not guarantee any specific volume of leads, appointments, or revenue. Results vary based on call volume, market conditions, and business factors outside our control.

3. Payment Terms

The FirstBack service is billed as follows:

  • Setup fee: No setup fee for founding customers. Standard setup fee may apply for future customers.
  • Monthly subscription: $497 per month, billed on the same date each month starting from the service activation date.
  • Payment method: All payments are processed through Stripe. You authorize us to charge your payment method on file for all applicable fees.
  • Late payments: Invoices unpaid for more than 7 days may result in service suspension. Accounts unpaid for more than 30 days may be terminated.

4. 30-Day Performance Guarantee

TownCall offers a 30-day performance guarantee for new customers. The terms are as follows:

  • If TownCall does not recover at least one booked job through the FirstBack platform within the first 30 days of active service, you are eligible for a full refund of your first month's subscription fee ($497).
  • If a setup fee was charged, it is non-refundable regardless of guarantee claims.
  • To qualify, your business must have an active phone line receiving calls during the guarantee period. Businesses that receive zero inbound calls during this period do not qualify.
  • A "booked job" is defined as any service appointment resulting from a customer conversation initiated by the FirstBack platform, including appointments confirmed through the platform's automated booking system or manually confirmed by the contractor following a FirstBack-initiated conversation.
  • The 30-day guarantee period begins on your account go-live date, not your signup date. Refund requests must be submitted before the guarantee period ends by emailing blake@towncall.ai. Requests submitted after the guarantee period has ended will not be eligible for a refund.
  • This guarantee applies to the first 30 days of service only and is limited to one claim per customer.

5. Cancellation Policy

You may cancel your TownCall subscription at any time. Cancellation terms:

  • No long-term contract is required. Service is month-to-month.
  • To cancel, email blake@towncall.ai or notify us through your account dashboard. Cancellation takes effect at the end of the current billing period.
  • No refunds are issued for partial months of service.
  • Upon cancellation, your dedicated phone number will be deactivated within 30 days of your cancellation date. Number porting requests may be accommodated at TownCall's discretion and may incur additional fees. TownCall is not obligated to facilitate number porting. You are responsible for notifying your customers of any number changes.
  • Conversation and appointment data will be retained for 90 days after cancellation, after which it will be permanently deleted.

6. Acceptable Use

You agree not to use TownCall services to:

  • Send unsolicited marketing or spam messages.
  • Engage in any activity that violates the Telephone Consumer Protection Act (TCPA) or other applicable telecommunications laws.
  • Misrepresent your identity or business in automated communications.
  • Use the platform for any unlawful, fraudulent, or harmful purpose.

We reserve the right to suspend or terminate accounts that violate these terms without notice.

7. SMS Terms

By using the FirstBack platform, you acknowledge and agree to the following SMS terms:

  • SMS messages are sent to callers who dial your business number and do not reach a live person. Messages are triggered by unanswered calls only.
  • Recipients can opt out at any time by replying STOP to any message. Opt-out requests are processed immediately.
  • Recipients can reply HELP for assistance or contact information.
  • Message frequency varies based on call activity and conversation engagement.
  • Standard message and data rates may apply depending on the recipient's mobile carrier and plan.
  • You are responsible for ensuring that your use of automated SMS through our platform complies with all applicable laws and regulations in your jurisdiction.

8. Limitation of Liability

To the maximum extent permitted by law:

  • TownCall provides its services "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • TownCall shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, or business opportunities, arising from your use of the service.
  • Our total liability for any claim arising from or related to the service shall not exceed the amount you paid to TownCall in the three (3) months preceding the claim.
  • TownCall is not liable for failures caused by third-party service outages (Twilio, Stripe, or carrier networks), force majeure events, or circumstances beyond our reasonable control.
  • TownCall is not responsible for the outcome of any appointment, lead, or customer interaction facilitated through the platform. Service quality and job completion remain the sole responsibility of the business customer.

9. Intellectual Property

All content, technology, trademarks, and intellectual property associated with TownCall and the FirstBack platform are owned by TOWNCALL LLC. You may not copy, modify, distribute, or create derivative works based on our platform without written permission.

10. Changes to Terms

We may update these Terms and Conditions from time to time. Material changes will be communicated via email to active subscribers. Continued use of our services after changes take effect constitutes acceptance of the updated terms.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.
